Why Rahul Gandhi has been disqualified as a MPOn March 23, 2023, Rahul Gandhi, a leader of the Indian National Congress party, was disqualified from the Lok Sabha, the lower house of India's congress, after being condemned in a vilification case by a Surat court. The court set up him shamefaced of saying," Why do all stealers, be it Nirav Modi, Lalit Modi or Narendra Modi, have Modi in their names?" at a rally in Kolar, Karnataka, in the run- up to the 2019 Lok Sabha choices. He was doomed to two times in jail, and the conviction touched off his disqualification as a legislator. Under the Representation of the People Act( RPA), a person condemned of a felonious offense and doomed to at least two times in captivity is disqualified from being a legislator. Disqualification is aimed at precluding the criminalization of politics and keeping alloyed lawgivers from querying choices.

Gandhi has to now move a advanced court and get his conviction stayed. Disqualification of a legislator is specified in three situations. First is through Articles 102( 1) and 191( 1) for disqualification of a member of Parliament and a member of the Legislative Assembly independently. The grounds then include holding an office of profit, being of unsound mind or insolvent, or not having valid citizenship. The alternate tradition of disqualification is in the Tenth Schedule of the Constitution, which provides for the disqualification of members on grounds of dereliction. The third tradition is under the RPA, 1951.

There are several vittles that deal with disqualification under the RPA. Section 9 deals with disqualification for redundancy
for corruption or disloyalty, and for entering into government contracts while being a legislator. Section 10 deals with disqualification for failure to lodge an account of election charges. Section 11 deals with disqualification for loose practices. Section 8 of the RPA deals with disqualification for conviction of offenses, including specific offenses similar as promoting hostility between two groups, bribery, and overdue influence or personation at an election. vilification isn't listed among these offenses.

He would have been arrested earlier but it's okay for the late. It is very good to keep such a fool outside the society. - Ashutosh Patel30-Mar-2023
