The major difference between sections 300 and 302 is that section 300 of the Indian Penal Code talks about Murder when is the Offence and under section 302 the Punishment of Murder is given.

Introduction

Indian Penal Code 1860 has a total of 511 sections, section 300 and 299 is very connected to each other and after the proving of the offense, the punishment is defined in section 302.

Herein, 300 it is mentioned some conditions under which the offence that has been committed will come under the Murder or the Culpable Homicide. And section 302 has the provision to give the punishment for committing an offence.


Section 300 of the Indian Penal Code

Section 300 has some condition under which the act which has been committed will come under the culpable homicide or in Murder. As it states

Accept in the cases hereinafter excepted, culpable homicide is murder, if the act by which the death is caused is done to cause death.

The section further has some conditions as an example of the act.


Section 302 of the Indian Penal Code

Section 302 has the provision of punishment for the offence committed by the accused of Murder as it said the murderer will be punished with death, or imprisonment of life, and also shall be liable to fine.


Major Difference between sections 300 and 302 of IPC

As above we can see both sections and we can conclude that section 300 has the provision to define the offence of Murder and section 302 has its punishment provision.

Here section 300 is prohibiting the act as a Murderer and section 302 is giving the power to Judges to punish the accused.
