Section 124 of the Indian Penal Code 1860 is related to the offences against the ‘State’ and in simple words, section 124 is also known as Sedition’. The development of the section had happened during the British rule and the moto behind the development of the section was to punish the persons who has the intent to harm the state and its property.

Section 124 of the Indian Penal Code

“Assaulting President, Governor, etc., with intent to compel or restrain the exercise the lawful power – whoever to include or compel the President of India or the Governor of any state to exercise or refrain from exercising in any manners any of the lawful powers of such President or Governor assault or wrongfully restrains, or attempts wrongfully to restrain or overawes, using criminal force or the show of criminal force, or attempts so to overawe, such President or Governor, shall be punished with imprisonment of either description for a term which may extend to seven years and shall also be liable to fine.

Definition of state

Here, the definition of the state varies from place to place as in article 13 of the Indian constitution tells about the broad definition of state in which even some privately-owned companies are also included but, in section 124 the means of the state is the Government body related to the President and Governor of the state and the property which comes under the control of the government.
