The [**Indian constitution**](https://answers.mindstick.com/qa/98329/from-which-country-is-the-preamble-of-the-indian-constitution-borrowed) is one of the most progressive constitutions in the world. It is a federal system, with each state having its own legislature and executive branch. However, there are many weaknesses of this constitution that have been identified by many different people over the years, including lawyers and political scientists.

The main weakness of the Indian constitution is its **lack of a strong** [**separation of powers**](https://answers.mindstick.com/qa/98220/were-nehru-and-gandhi-responsible-for-the-partition-of-india)**.** There are three branches of government in India: the executive, the legislature, and the judiciary. However, these three branches are not clearly separated from one another, which makes it difficult for them to function as independent entities.

Another weakness is that it **lacks clarity regarding its implementation.** There are a number of problems with how the constitution was drafted and how it has been implemented. For example, there is no clear process for amending the constitution, which means that any changes in government or policy must be made through a referendum or other similar process. This can lead to significant delays in implementing changes, and also makes it difficult for citizens to know what their rights are under the constitution without having to go through an arduous process to find out.

Another problem with implementation is that there are not **enough checks on executive power in India.** The [**president**](https://en.wikipedia.org/wiki/President_of_India) has wide powers under their office, including the ability to declare war and make treaties without consulting parliament first. This means that there is little oversight over their decisions and they can act without regard for public opinion or democratic principles.

One weakness is that it does **not include a bill of rights for Indians** as it does for [**Americans**](https://answers.mindstick.com/qa/98306/who-has-the-most-power-in-the-white-house). Another weakness is that it does not provide for **proportional representation in parliament** (the lower house).
