> **The National Emergency in India has been imposed many times and the first National Emergency was imposed during the China attack in 1962. He was elected in 1962 and before his Presidency, Dr. Rajendra Prashad was the President of India.**

## Overview

The provision of the Emergency in India has been taken from Germany’s constitution and there has been described three types of emergency that are given under-

- National Emergency under the **article of 352.**
- State Emergency under **article 358.**

The National Emergency in India has been defined in article 352 of the constitution and it can be enacted by the power of the President of the country.

- Grounds for National Emergency
- War
- External Aggressions
- Armed rebellion
- If the President of the country feels that the Security of the Nation is under threat then he may declare the National Emergency.

## Proclamation of Emergency in India

There have been many proclamations of Emergency in the history of India and I would like to describe the proclamations.

## The first proclamation of National Emergency

On the 21st of October 1962, the then President announced the emergency based on external aggression.

## Second proclamation of National Emergency

On 3rd December 1971, Pakistan attacked India, and in the war, India has won the victory.

## Third National Emergency

This Emergency was proclaimed on 25th June 1975 and the reason was the internal disturbance.
