> **A person who is an Indian citizen and a part of either house of Parliament would be qualified to become Prime Minister. If he is a member of Lok Sabha, he must be 25 years old, and if Rajya Sabha, he must be 30 years old.**

The [Prime Minister of India](https://en.wikipedia.org/wiki/Prime_Minister_of_India), or the Prime Minister of the Republic of India, is the leader of the Indian government's executive branch. The prime minister is **the governing member of the central government's Council of Ministers and the head of the federal cabinet**. They can serve in India's Parliament's [Lok Sabha](https://answers.mindstick.com/qa/94230/who-was-the-person-to-speak-against-the-muslim-woman-protection-of-rights-on-divorce-bill-in-the-lok-sabha-but-voted-for-it) or Rajya Sabha, but they must be a member of a political party or coalition that has a majority in the Lok Sabha. \
In the parliamentary system, the prime minister is the most senior cabinet member in the executive arm of the [government](https://answers.mindstick.com/qa/94237/which-form-of-the-government-has-division-of-powers-and-independent-judiciary-as-the-important-characteristics). The prime minister appoints and dismisses cabinet members, assigns duties to members of the government, and serves as the cabinet's presiding member and chairman. \

## Eligibility Criteria

According to Article 84 of the Indian Constitution, which establishes the basic qualifications for a member of Parliament, and Article 75 of the Indian Constitution, which establishes the basic qualifications for a minister in the Union Council of Ministers, and the assertion that the [prime minister's](https://answers.mindstick.com/qa/93648/was-subhash-chandra-bose-ji-the-first-prime-minister-of-india) position has been described as primus inter pares (first among equals), a prime minister must:

- be an **Indian citizen**
- be a part of the **Rajya Sabha or the Lok Sabha.** If the prime minister is not a part of either the Lok Sabha or the Rajya Sabha at the time of appointment, he or she must join one of the two chambers within six months.
- If they are a part of the Lok Sabha, they must be over **25 years old**, and if they are a part of the [Rajya Sabha](https://answers.mindstick.com/qa/38523/name-the-bill-which-was-recently-approved-by-the-rajya-sabha-and-is-a-pioneering-initiative-to-protect-the-interest-of-consumers-promote-fair-play-in-real-estate-transactions-and-to-ensure-timely-execution-of-projects), they must be over **30 years old.**
- not occupy a **profit-making position in the Indian government**, any state government, or any local or other authority under the supervision of any of the aforementioned governments.

If a person is voted prime minister, they must **resign from any government or private job** and may only take up the position once their tenure has ended.
